第十九条矿山企业对使用机械、电气设备，排土场、矸石山、尾矿库和矿山闭坑后可能引起的危害，应当采取预防措施。

第四章矿山企业的安全管理

第二十条矿山企业必须建立、健全安全生产责任制。

Article20Miningenterprisesmustestablishandimprovethesafeproductionresponsibilitysystem.

矿长对本企业的安全生产工作负责。

Managersofminesshallberesponsibleforthesafeproductionintheirrespectiveenterprises.

第二十一条矿长应当定期向职工代表大会或者职工大会报告安全生产工作，发挥职工代表大会的监督作用。

Article21Managersofminesshall,onaregularbasis,reporttheirworkonsafeproductiontothecorrespondingcongressesofworkersandstafforassembliesofworkersandstaff,thusbringingintoplaythesupervisoryroleofthecongressesofworkersandstaff.

第二十二条矿山企业职工必须遵守有关矿山安全的法律、法规和企业规章制度。

Article22Workersandstaffofminingenterprisesmustobservethelaws,regulationsandenterpriserulesconcerningsafetyinmines.

矿山企业职工有权对危害安全的行为提出批评、检举和控告。

Workersandstaffofminingenterpriseshavetherighttomakecriticisms,reportsandchargesagainstanyconductthatendangerssafety.

第二十三条矿山企业工会依法维护职工生产安全的合法权益，组织职工对矿山安全工作进行监督。

Article23Tradeunionsofminingenterprisesshallsafeguard,inaccordancewiththelaw,thelawfulrightsandinterestsoftheworkersandstaffinrelationtosafeproduction,organizetheworkersandstafftocarryoutsupervisionoverthesafetyworkofthemines.

第二十四条矿山企业违反有关安全的法律、法规，工会有权要求企业行政方面或者有关部门认真处理。

Article24Ifaminingenterpriseviolatesanylawsorregulationsconcerningsafety,thetradeunionisentitledtodemandthatthemanagementoftheenterpriseorthedepartmentconcerneddealwiththecasesseriously.

矿山企业召开讨论有关安全生产的会议，应当有工会代表参加，工会有权提出意见和建议。

Meetingsheldbyminingenterprisestodiscussmattersconcerningsafeproductionshallbeattendedbyrepresentativesoftradeunions,andtradeunionshavetherighttoadvancetheiropinionsandproposals.

第二十五条矿山企业工会发现企业行政方面违章指挥、强令工人冒险作业或者生产过程中发现明显重大事故隐患和职业危害，有权提出解决的建议；发现危及职工生命安全的情况时，有权向矿山企业行政方面建议组织职工撤离危险现场，矿山企业行政方面必须及时作出处理决定。

第二十六条矿山企业必须对职工进行安全教育、培训；未经安全教育、培训的，不得上岗作业。

Article26Miningenterprisesmustgivesafetyeducationandtrainingtotheirworkersandstaff;thosewhohavenotreceivedsafetyeducationandtrainingmaynottakeupapostofduty.

矿山企业安全生产的特种作业人员必须接受专门培训，经考核合格取得操作资格证书的，方可上岗作业。

Specialoperatorsinchargeofsafeproductioninminingenterprisesmustreceivespecialtraining;theymaytakeupapostofsuchdutyonlyaftertheyhaveobtainedacertificateofoperationqualificationafterpassingdueexaminationandverification.

Article27Managersofminesmustprove,throughexamination,tohavespecialknowledgeofsafetyandthecapabilityofleadingsafeproductionanddisposingofaccidentsinmines.

矿山企业安全工作人员必须具备必要的安全专业知识和矿山安全工作经验。

Personnelinchargeofsafetyworkinminingenterprisesmustpossessnecessaryspecializedknowledgeofsafetyandexperienceinsafetyworkinmines.

第二十八条矿山企业必须向职工发放保障安全生产所需的劳动防护用品。

Article28Miningenterprisesmustdistributetotheirworkersandstafflabourprotectivegadgetsnecessaryforguaranteeingsafeproduction.

第二十九条矿山企业不得录用未成年人从事矿山井下劳动。

Article29Miningenterprisesmaynotrecruitadolescentstoengageinundergroundwork.

矿山企业对女职工按照国家规定实行特殊劳动保护，不得分配女职工从事矿山井下劳动。

MiningenterprisesshallinaccordancewithregulationsoftheStatepractisespeciallabourprotectionwithrespecttowomenworkersandstaff,andmaynotassignwomenworkersanyundergroundwork.

第三十条矿山企业必须制定矿山事故防范措施，并组织落实。

Article30Miningenterprisesmustadoptpreventivemeasuresagainstaccidentsinmines,andberesponsiblefortheirimplementation.

第三十二条矿山企业必须从矿产品销售额中按照国家规定提取安全技术措施专项费用。

Article32Miningenterprisesmust,inaccordancewithregulationsoftheState,drawspecialfundsforsafetytechnicalmeasuresfromtheamountofsalesoftheirmineralproducts.

安全技术措施专项费用必须全部用于改善矿山安全生产条件，不得挪作他用。

Thespecialfundsforsafetytechnicalmeasuresmustbeusedexclusivelytoimproveconditionsofsafeproductioninminesandmaynotbedivertedtoanyotherpurposes.

第五章矿山安全的监督和管理

CHAPTERVSUPERVISIONANDCONTROLOVERSAFETYINMINES

第三十三条县级以上各级人民政府劳动行政主管部门对矿山安全工作行使下列监督职责：

Article33Competentdepartmentsoflabouradministrationofthepeople'sgovernmentsatorabovethecountylevelshallexercisethefollowingsupervisoryfunctionsandresponsibilitieswithrespecttosafetyworkinmines:

(一)检查矿山企业和管理矿山企业的主管部门贯彻执行矿山安全法律、法规的情况；

(1)toinspecttheimplementationoflawsandregulationsonsafetyinminesbyminingenterprisesandtheauthoritiesinchargeofminingenterprises;

(二)参加矿山建设工程安全设施的设计审查和竣工验收；

(三)检查矿山劳动条件和安全状况；

(3)toinspecttheworkingconditionsandstateofsafetyinmines;

(四)检查矿山企业职工安全教育、培训工作；

(4)toinspecttheworkofgivingeducationandtraininginsafetytoworkersandstaffbyminingenterprises;

(五)监督矿山企业提取和使用安全技术措施专项费用的情况；

(5)tosupervisetheallocationanduseofthespecialfundsforsafetytechnicalmeasuresbyminingenterprises;

(六)参加并监督矿山事故的调查和处理；

(6)toparticipateinandsuperviseinvestigationanddispositionofaccidentsinmines;

(七)法律、行政法规规定的其他监督职责。

(7)othersupervisoryfunctionsandresponsibilitiesprovidedforinlawsandadministrativerulesandregulations.

第三十四条县级以上人民政府管理矿山企业的主管部门对矿山安全工作行使下列管理职责：

Article34Theauthoritiesinchargeofminingenterprisesunderthepeople'sgovernmentsatorabovethecountylevelshallexercisethefollowingfunctionsandresponsibilitieswithrespecttothecontrolofsafetyworkinmines:

(一)检查矿山企业贯彻执行矿山安全法律、法规的情况；

(1)toinspecttheimplementationoflawsandregulationsonsafetyinminesbyminingenterprises;

(二)审查批准矿山建设工程安全设施的设计；

(2)toexamineandapprovedesignsofsafetyfacilitiesinmineconstructionprojects;

(三)负责矿山建设工程安全设施的竣工验收；

(四)组织矿山和矿山企业安全工作人员的培训工作；

(五)调查和处理重大矿山事故；

(5)toinvestigateanddealwithseriousaccidentsinmines;and

(六)法律、行政法规规定的其他管理职责。

(6)othercontrollingfunctionsandresponsibilitiesprovidedforinlawsandadministrativerulesandregulations.

第三十五条劳动行政主管部门的矿山安全监督人员有权进入矿山企业，在现场检查安全状况；发现有危及职工安全的紧急险情时，应当要求矿山企业立即处理。

CHAPTERVIDISPOSITIONOFACCIDENTSINMINES

第三十六条发生矿山事故，矿山企业必须立即组织抢救，防止事故扩大，减少人员伤亡和财产损失，对伤亡事故必须立即如实报告劳动行政主管部门和管理矿山企业的主管部门。

第三十七条发生一般矿山事故楼梯围护栏杆施工方案，由矿山企业负责调查和处理。
